High Court's stay order on DUCSU elections overturned

High Court’s stay order on DUCSU elections overturned. The full appellate bench has overturned the High Court’s order suspending the Dhaka University Central Students’ Union (DUCSU) elections. As a result, there is no obstacle to the DUCSU elections on September 9.

Today, Wednesday (September 3), the appellate bench headed by Chief Justice Dr. Syed Refat Ahmed gave the verdict in a hearing. Advocate Mohammad Shishir Monir is hearing on behalf of Dhaka University.

Earlier on Monday, the High Court had suspended the DUCSU elections until October 30. However, in the afternoon, the Chamber Court of the Appellate Division suspended that order. Justice Farah Mahbub gave the order after hearing the appeal filed by the university in the Chamber Court.

The Chamber Court also directed the Dhaka University authorities to appeal to the Appellate Division against the High Court’s order. Accordingly, the university authorities filed an appeal yesterday. Later, the Chamber Court sent the matter to the full bench of the Appellate Division for hearing.

On Monday, a bench of Justice Habibul Gani and Justice Sheikh Tahsin Ali suspended the DUCSU elections.

The High Court passed the order while hearing a writ petition challenging the candidacy of DUCSU GS candidate SM Farhad, nominated by the United Students’ Alliance. Barrister Jyortimay Barua heard the petition.

In the High Court order, the writ petitioner and DUCSU election candidate for Liberation War and Democratic Movement Affairs, BM Fahmida Alam, was asked to submit all the allegations against GS candidate SM Farhad to the DUCSU Election Tribunal within the next 15 days.

The Dhaka University authorities appealed to the Appellate Division against the order.
